Terms and Conditions – Donations & Program Enrolment
- Donations help fund coaching, venues, compliance, education, and outreach.
- All enrolments require meeting eligibility, safety, and conduct standards.
- Payments and donations are generally non-refundable unless required by law.
1. Introduction
These Terms and Conditions govern all donations, contributions, sponsorships, and program enrolments made to Giving Back Hope with Jeff Fenech (“Giving Back Hope”, “we”, “our”, or “us”).
By making a donation or enrolling in any program, you agree to be bound by these Terms and Conditions.
2. About Giving Back Hope
Giving Back Hope is a community-based initiative dedicated to supporting youth, families, and individuals through education, mentoring, kickboxing / boxing-based engagement programs, wellbeing support, and community development initiatives.
The organisation operates in accordance with Australian laws governing charitable, not-for-profit, and community organisations.
3. Donations
3.1 Use of Funds
- •Delivery of youth and community programs.
- •Equipment and training resources.
- •Venue hire and program facilities.
- •Insurance and compliance costs.
- •Educational materials.
- •Staff, contractors, coaches, and facilitators.
- •Administrative and operational expenses.
- •Marketing, awareness, and outreach.
- •Any other activities reasonably necessary to operate the project.
- •Funds will be allocated at the discretion of the Directors or appointed governing body, aligned with organisational objectives.
3.2 No Earmarking Guarantee – Donations are unrestricted unless otherwise agreed in writing and may be allocated according to organisational priorities. 3.3 Non-Refundable Donations – All donations are voluntary, non-refundable, and non-transferable except where required by Australian law.
4. Tax Deductibility
Donations may be tax deductible only if Giving Back Hope is registered as a Deductible Gift Recipient (DGR) and a valid tax receipt is issued.
Donors are responsible for confirming their own tax obligations and eligibility. Giving Back Hope does not provide financial or taxation advice.
5. Fundraising Compliance
Giving Back Hope complies with:
- •Australian Consumer Law
- •State-based fundraising legislation
- •Australian Charities and Not-for-profits Commission (ACNC) requirements
- •Applicable reporting and governance obligations
Fundraising may be conducted online, in person, at events, or via approved third-party platforms.
6. Program Enrolment
6.1 Eligibility
Participation in Giving Back Hope programs may be subject to:
- •Age requirements
- •Medical clearance where appropriate
- •Parental or guardian consent for minors
- •Behavioural expectations and safety standards
The organisation reserves the right to accept or refuse enrolment at its discretion.
6.2 Program Fees
Where applicable:
- •Program fees contribute toward operational and delivery costs
- •Fees are not considered charitable donations unless stated otherwise
- •Fees may be non-refundable once a program has commenced
7. Participant Conduct
All participants agree to:
- •Act respectfully toward staff and other participants
- •Follow safety instructions
- •Comply with organisational rules and policies
- •Maintain appropriate behaviour
Giving Back Hope reserves the right to suspend or terminate participation for misconduct or safety concerns.
8. Risk Acknowledgement
Certain programs may involve physical activity including boxing-based or fitness-related training.
Participants acknowledge:
- •Physical activity carries inherent risks
- •Participation is voluntary
- •They accept responsibility for their own health and fitness capacity
Participants may be required to complete waivers or medical declarations prior to participation.
9. No Guarantee of Outcomes
Giving Back Hope provides mentoring and development programs designed to support wellbeing, confidence, and life skills.
However:
- •Outcomes vary between individuals
- •No guarantees are made regarding results
- •Participation does not replace professional medical, psychological, or legal advice
Participants may be required to complete waivers or medical declarations prior to participation.
10. Financial Governance
All funds received by Giving Back Hope are:
- •Managed responsibly
- •Accounted for in financial records
- •Applied toward organisational objectives
- •Governed by the Directors in accordance with Australian law
No profits are distributed to members or directors.
11. Intellectual Property
All content, branding, logos, program materials, and media associated with Giving Back Hope remain the intellectual property of the organisation unless otherwise stated.Unauthorised reproduction is prohibited.
12. Privacy
Personal information collected through donations or enrolments is handled in accordance with our Privacy Policy, available on our website.

13. Limitation of Liability
To the maximum extent permitted by Australian law:
- •Giving Back Hope excludes liability for indirect or consequential loss
- •Liability is limited where permitted under the Australian Consumer Law
- •Nothing in these terms excludes rights that cannot be excluded by law
14. Amendments
Giving Back Hope reserves the right to amend these Terms and Conditions at any time. Updated terms will be published on the website and take effect immediately.
15. Governing Law
These Terms and Conditions are governed by the laws of Australia, including the laws of the applicable State or Territory.
